Foreign Investment in Real Property Tax Act of 1980 income tax withholding, also known as FIRPTA is a process that frequently occurs when there’s a disposition of a U.S. real estate property involving a foreign person.
This process is usually required between the Title Company and the IRS when the transferor/seller is a foreign person. The transferee/buyer in most cases is the withholding agent and is obligated to withhold a percentage from the foreign transferor/seller, otherwise they may be held liable for the tax.
